Terms of Service

1. Service Description

Buildit is an AI-powered code generation platform that creates static websites, web applications, and software projects from natural language prompts. Output is generated by large language models (LLMs) and delivered as downloadable source code.

The Service is provided "as is." We do not guarantee that generated code is error-free, complete, or suitable for any particular purpose. You are responsible for reviewing, testing, and deploying code generated by the Service.

2. Accounts

• You must be at least 18 years old (or the age of digital consent in your country) to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information during registration. False information may result in account termination.
• One account per person. You may not share accounts or create multiple accounts to circumvent limits.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Tokens, Plans & Payments

• Tokens are consumed each time you run a build. Token costs vary by project complexity.
• Free plan includes a one-time trial token grant. Paid plans and token packs are available for purchase.
• All payments are processed by Razorpay. We do not store card details.
• Prices are listed in INR (Indian Rupees) and are inclusive of GST where applicable.
• Refunds: Token packs and plan upgrades are non-refundable once tokens have been consumed. If you experience a technical failure that consumed tokens without generating output, contact us within 7 days at support@aisoftwarefactory.in.
• We may change pricing at any time. Existing token balances are unaffected by price changes.

4. Acceptable Use

You agree not to use the Service to generate:

• Malware, spyware, ransomware, or any software designed to harm or deceive
• Phishing sites, scam pages, or fraudulent content
• Content that is illegal under Indian law or the laws of your jurisdiction
• Content that infringes third-party intellectual property rights
• Hate speech, harassment, or content targeting individuals based on protected characteristics
• Content that sexually exploits minors (CSAM) — violations will be reported to authorities

Violation of this section may result in immediate account termination and, where required by law, reporting to relevant authorities.

5. Intellectual Property

Your prompts: You retain ownership of prompts you submit. By submitting prompts, you grant us a limited licence to process them to provide the Service.

Generated code: Subject to Section 4, you own the code generated from your prompts and may use it for any purpose, including commercial use, without attribution or royalties to us.

Our platform: The Buildit platform, UI, branding, and underlying systems remain our intellectual property. You may not copy, reverse-engineer, or resell the platform itself.

Third-party licences: Generated code may incorporate patterns from open-source libraries. You are responsible for complying with the licences of any third-party code or CDN resources used in your generated projects.

6. AI Limitations & No Warranty

• AI-generated code may contain bugs, security vulnerabilities, or logical errors. Always review output before deploying to production.
• We do not warrant that generated code is secure, complete, or fit for purpose.
• The Service may be unavailable due to maintenance, model API outages, or technical issues.
• Token consumption is not refunded for API-side failures beyond our control (e.g., third-party LLM outages) unless we are notified within 7 days.

7. Limitation of Liability

To the maximum extent permitted by law, Buildit and its directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

8. Data & Privacy

Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you also agree to the Privacy Policy.

9. Account Deletion

You may delete your account at any time from Settings → Delete Account. Upon deletion:

• All your builds, prompts, and token history are permanently deleted.
• GST invoices and payment records are retained for 7 years as required by Indian tax law.
• Any remaining token balance is forfeited. Unused tokens are non-refundable.

10. Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraud, or if we are required to do so by law. In cases of non-violation termination (e.g., service discontinuation), we will provide at least 30 days' notice by email and allow you to export your projects.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms shall first be attempted to be resolved amicably by contacting us at legal@aisoftwarefactory.in. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of India.

If you are an EU/UK consumer, you retain the right to bring claims before your local courts under applicable consumer protection law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or an in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
